This page (together with our Privacy Policy available via the link at the bottom of the fujifilm-inkjet.co.uk web site (our Privacy Policy)) tells you information about us and the legal terms and conditions (Terms) on which we sell any of the products (Products) available from the FUJIFILM Inkjet Shop and from the Service & Support section (together referred to as the Store) of the https://www.fujifilmimaging.com (our site) to you.

 

Our Terms

These Terms will apply to orders submitted by you to FUJIFILM UK Limited over the phone or online for Products and will, together with our Privacy Policy, form the basis of any contract between us for the sale of Products to you (Contract). Please read these Terms carefully and make sure that you understand them, before ordering any Products from the Store. Please note that before placing an order you will be asked to agree to these Terms.

Please click on the button marked "I Accept" in the ordering process if you accept them. If you refuse to accept these Terms, you will not be able to order any Products from the Store.

You should print a copy of these Terms or save them to your computer for future reference.

We may amend these Terms from time to time. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time.

These Terms, and any Contract between us, are only in the English language.

 

If you are a consumer

The following paragraphs (i) and (ii) only apply if you are a consumer.

(i)

The Store is only intended for use by people resident in the United Kingdom. We do not accept orders from outside the United Kingdom. By placing an order through the Store, you warrant that

(a)

You are legally capable of entering into binding contracts;

(b)

You are at least 18 years old;

(c)

You are resident in the United Kingdom; and

(d)

You are accessing the Store from that country.

(ii)

We intend to rely upon these Terms (together with our Privacy Policy) in relation to the subject matter of our contract with you. While we accept responsibility for statements and representations made by our duly authorised representatives, please make sure you ask for any variations from these Terms to be confirmed in writing.

 

If you are a business customer

If you are not a consumer, you warrant that you have authority to bind any business on whose behalf you use the Store to purchase Products. We do not accept orders through the Store from outside the United Kingdom.

These Terms and our Privacy Policy constitute the entire agreement between you and us. You acknowledge that you have not relied on any statement, promise or representation made or given by us or on our behalf which is not set out in these Terms or our Privacy Policy.

 

Prices, Postage & Packing

Prices, postage & packing charges shall be as specified in the Store, as determined when ordering over the phone or online. Our prices in the Store include any applicable value added taxes. We reserve the right to change prices published in the Store at any time.

 

Payment

Payment for Products ordered over the telephone or online must be made by credit or debit card. We cannot accept Solo, Electron or American Express cards. Products ordered shall not be despatched until authorisation of the credit card payment has been made.

 

Credit/Debit card security online

We take security and customer service very seriously and appreciate the trust placed in us by all of our customers when giving us their card details. For this reason, we have implemented a fully hosted payment solution provided by Sage Pay Europe Limited (Sage Pay). Sage Pay is compliant to the highest level (level 1) of the PCI-DSS (Payment Card Industries Data Security Standard). Sage Pay collects, processes and stores the card details on their system at the time of order. Card details are stored with Sage Pay for 6 months allowing us to quickly issue refunds where necessary. FUJIFILM UK Limited employees have no access to any sensitive customer information, including card details held within the Sage Pay systems. Our employees use reference numbers, supplied to us by Sage Pay at the time of order, to conduct any refunds or cancellations.

At no time does FUJIFILM UK Limited store or transmit any sensitive card details.

 

SSL

When you send us your personal information, the link between your PC and our server is encrypted using Industry standard methods - usually referred to as SSL (128 bit encryption).

 

Accepting orders

When you place an order online or by telephone we will treat it as an offer to buy. We will send you confirmation e-mail with your order number, at which point we make a legal contract with you. However, we will be entitled to refuse to accept your order if we feel it necessary, in which case we will e-mail you as soon as we can to let you know.

When you order you will have an opportunity to check the details and correct any input errors.

In deciding whether to accept your order, we may use the information you have given to us, or we already hold about you, or which we receive from any enquiry we may make with our credit checking company to confirm your identity. The credit checking company will check any details we disclose to them against any database (public or private) to which they have access and will keep a record of that check. The credit checking company will also retain this information and may use it in the future to assist other companies with identity verification. This assists us to protect you and us from fraudulent transactions. If we decline your offer on security grounds we may contact you to seek an alternative payment method.

The Contract created between you and us by our acceptance of your order is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of such Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of such Contract, or any of our rights or obligations arising under it, at any time during the term of such Contract.

 

Availability

All Products shown in the Store are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available and we will not process your order for that Product.

 

Cancellation of Order

We reserve the right to cancel any accepted order prior to delivery, at our discretion (whether or not your credit card has already been charged), in case of any material errors in connection with your order, the price or other conditions published in the Store relevant for your order. If your credit card has already been charged and your order is cancelled, we will immediately upon confirmation issue an appropriate credit to your credit card account.

 

Delivery

All orders received by 11.30am will be dispatched the same working day. All orders received after 11:30am will be dispatched on the next working day. All deliveries are via UK Mail. UK delivery costs will be based on the value of the order. Most orders under £250 will be subject to a £6.50 delivery charge. Orders exceeding £250 will be delivered free of charge. 

Delivery will be completed when we deliver the Products to the address you gave us.

We regret we are unable to deliver to BFPO addresses.

 

Failure to deliver if you are a consumer

The following paragraphs only apply if you are a consumer

In the unlikely event that your Products are not delivered within 30 days of the date on which you received your confirmation email then you may cancel your order straight away if any of the following apply:

 

(a)

We have refused to deliver the Products;

(b)

Delivery within the delivery deadline was essential (taking into account all the relevant circumstances); or

(c)

You told us before we accepted your order that delivery within the delivery deadline was essential.

 

If you do not wish to cancel your order straight away, or do not have the right to do so above, you can give us a new deadline for delivery, which must be reasonable, and you can cancel your order if we do not meet the new deadline.

If you do choose to cancel your order for late delivery in accordance with the above provisions, you can do so for just some of the Products or all of them, unless splitting them up would significantly reduce their value. If the Products have been delivered to you, you will have to return them to us and we will pay the costs of this. Please contact us by email at admin.photofinishing_uk@fujifilm.com or by telephone on 0333 0 100200 and and we will arrange collection of your order at no cost to you. After you cancel your order we will refund any sums you have paid to us for the cancelled Products and their delivery.

Occasionally our delivery to you may be affected by an Event Outside Our Control. See the section headed Events Outside Our Control for our responsibilities when this happens.

 

Title to goods

Title to all Products ordered passes to you upon the full payment or delivery of Products. Risk of loss and damage pass to you upon delivery.

 

Promotional Codes

Promotional codes cannot be used in conjunction with any existing offers contained within the Store. If this was to happen, the best discount by value would be offered. Promotional codes are created only for use in the Store.

 

Your cancellation and refund rights if you are a consumer

The following paragraphs (i) to (iv) only apply if you are a consumer.

 

(i)

Cancellation 

If you are a consumer, you have a legal right to cancel your contract with us under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 during the period set out in the paragraph below even if you have opened the Products to inspect them (save as provided below for certain types of Products). This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep any Products, you can notify us of your decision to cancel the contract and receive a refund. Advice about your legal right to cancel the contract is available from your local Citizens' Advice Bureau or Trading Standards office. However, this cancellation right does not apply in the case of sealed computer software, once these Products are unsealed after you receive them.

Your legal right to cancel the contract starts from the date of the confirmation email (the date on which we e-mail you to confirm our acceptance of your order), which is when the contract is formed. Your deadline for cancelling the contract then depends on what you have ordered and how it is delivered, as set out in the table below:


Your contract

End of the cancellation period

Your contract is for a single Product (which is not delivered in instalments on separate days).

The end date is the end of 14 days after the day on which you receive the Product. 
Example: if we provide you with a confirmation email on 1 January and you receive the Product on 10 January you may cancel at any time between 1 January and the end of the day on 24 January.

Your contract is for either of the following: 
one Product which is delivered in instalments on separate days. 
multiple Products which are delivered on separate days.

The end date is 14 days after the day on which you receive the last instalment of the Product or the last of the separate Products ordered. 
Example: if we provide you with a confirmation email on 1 January and you receive the first instalment of your Product or the first of your separate Products on 10 January and the last instalment or last separate Product on 15 January you may cancel in respect of all instalments and any or all of the separate Products at any time between 1 January and the end of the day on 29 January.


To cancel the contract, you just need to let us know that you have decided to cancel. The easiest way to do this is to complete the cancellation form found HERE and on the page https://www.fujifilmimaging.com/order-cancellation-request. A link to the website cancellation form will be included in our confirmation email. If you use this method we will e-mail you to confirm we have received your cancellation.

You can also e-mail us at admin.photofinishing_uk@fujifilm.com or contact us by telephone on 0333 0 100200. If you are e-mailing us please include details of your order to help us to identify it. If you send us your cancellation notice by e-mail, then your cancellation is effective from the date you send us the e-mail. For example, you will have given us notice in time as long as you e-mail us before midnight on that day.

If you cancel your contract we will:


(a)

Refund you the price you paid for the Products. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the Products, if this has been caused by your handling them in a way which would not be permitted in a physical shop.

(b)

Refund any delivery costs you have paid, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method we offer (provided that this is a common and generally acceptable method).

(c)

Make any refunds due to you as soon as possible and in any event within the deadlines indicated below: 

(i)

If you have received the Products: 14 days after the day on which we receive the Products back from you or, if earlier, the day on which you provide us with evidence that you have sent the Products back to us. For information about how to return Products to us, see below; or

(ii)

If you have not received the Products: 14 days after you inform us of your decision to cancel the contract.

We will refund you on the credit card or debit card used by you to pay.


If Products have been delivered to you before you decide to cancel your contract:

(a)

Then you must return them to us at Unit 10a, St Martins Business Centre, St Martins Way, Bedford MK42 OLF without undue delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the contract; and

(b)

Unless the Products are damaged, faulty or not as described (in this case, see Damaged Goods or Faulty Goods below) you will be responsible for the cost of returning the Products to us. If the Products are such that they cannot be returned by post, we estimate that if you use the carrier which delivered the Products to you, these costs should not exceed the sums we charged you for delivery.

Because you are a consumer, we are under a legal duty to supply goods that are in conformity with the contract. As a consumer, you have legal rights in relation to goods that are faulty or not as described. These legal rights are not affected by your right of return and refund in this Returns section or anything else in these terms and conditions. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.

(ii)

Returns 
Additionally if, for any reason, you change your mind and would like to return your order after delivery, we are happy to offer you a refund or exchange provided your item is unopened and in the original packaging. This option is available for twenty one days after you receive your order.

The Products must be returned with all accessories, packaging, instructions, etc and must be in unused condition. Digital Products can only be accepted if the software is still sealed.

A proof of purchase must be supplied. Where we have made a charge for delivery, this will be deducted from your refund.

(iii)

Damaged Goods 
What happens if my item arrives damaged or is not as described?

On rare occasions, an item may get damaged in transit or may not be as described. If you do receive a damaged item or it is not as described, please call us within 48 hours on 0333 0 100200 and we will arrange collection of your order at no cost to you. We will then either refund the cost of the item plus the delivery charge paid (from original order) or replace your item.

(iv)

Faulty Goods 
What happens if my item is faulty?

If the fault happens within thirty days of the date of delivery, you have the option of either a refund or an exchange. After thirty days the item would be covered by the one year manufacturer’s warranty period or the six month warranty period offered by us and will be repaired.

Please note that we may ask to inspect the item to confirm any fault before a refund or an exchange is processed

If the fault occurs within thirty days, please call us on 0333 0 100200 and we will arrange collection of your order at no cost to you. We will then either refund the cost of the item plus the delivery charge paid (from original order) or replace your item.

 

Your statutory rights are unaffected.

 

 

Price Protection

If the price of an item you buy in the Store is lowered within seven (7) days of the date of your purchase, we will honour the new price and credit you with the difference. To obtain your credit, please send an email to admin.photofinishing_uk@fujifilm.com, including your name, address and order number.

Please note:

  • Requests for price adjustment credits must be made within thirty (30) days of the date of purchase.

  • We will honour only one price adjustment credit per item.

 

Goods purchased using a promotion code are not eligible for price adjustment credits.

 

Warranty

For Products which do not have a manufacturer's guarantee, we provide a warranty that on delivery and for a period of six months from delivery, the Products shall be free from material defects. However, this warranty does not apply to any defect in the Products arising from:

 

(i)

Fair wear and tear;

(ii)

Wilful damage, abnormal storage or working conditions, accident, negligence by you or by any third party;

(iii)

If you fail to operate or use the Products in accordance with the user instructions; or

(iv)

Improper use of Products or any alteration or repair by you or by a third party who is not one of our authorised repairers.

 

If you are a consumer, this warranty is in addition to your legal rights in relation to goods that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.

 

Our liability if you are a consumer

The following paragraphs (i) to (iii) only apply if you are a consumer

 

(i)

Subject to paragraph (iii) below, if we fail to comply with these Terms, we shall only be liable to you for the purchase price of the Product and, subject to paragraph (b) below, any other losses or damage that you suffer as a result of our failure to comply (whether arising in contract, tort (including negligence), breach of statutory duty or otherwise) which are a foreseeable consequence of such failure. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

(ii)

If you use the goods for any commercial, business or re-sale purpose then, subject to paragraph (iii) below, we will not be liable for losses that result from our failure to comply with these Terms that fall into the following categories: 





(a)

Loss of income or revenue;

(b)

Loss of business;

(c)

Loss of profits;

(d)

Loss of anticipated savings;

(e)

Loss of data; or

(f)

Waste of management or office time.

(iii)

Nothing in these Terms excludes or limits our liability for: 





(a)

Death or personal injury caused by our negligence;

(b)

Fraud or fraudulent misrepresentation;

(c)

Any breach of the obligations implied by the Consumer Rights Act 2015; or

(d)

Defective products under the Consumer Protection Act 1987.

 

Our liability if you are a business

 (i)

Subject to paragraph (ii) below we will under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract for any: 

(a)

Loss of profits, sales, business, or revenue;

(b)

Loss or corruption of data, information or software;

(c)

Loss of business opportunity;

(d)

Loss of anticipated savings;

(e)

Loss of goodwill; or

(f)

Indirect or consequential loss.

(ii)

Nothing in these Terms excludes or limits our liability for: 

(a)

Death or personal injury caused by our negligence;

(b)

Fraud or fraudulent misrepresentation;

(c)

Any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession); or

(d)

Defective products under the Consumer Protection Act 1987.

(iii)

Subject to paragraphs (i) and (ii) above, our total liability to you in respect of all other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed 105% of the price of the Products in respect of which the liability arises.

(iv)

Except as expressly stated in these Terms, we do not give any representation, warranties or undertakings in relation to the Products. Any representation, condition or warranty which might be implied or incorporated into these Terms by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that the Products are suitable for your purposes.

 

Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under any contract with you that is caused by events outside our reasonable control (Event Outside Our Control) including, without limitation, fire, flood, explosion, storm, earthquake, war, terrorism, sabotage, revolution, riot or civil commotion, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority, strikes, lockouts, failure of supplies of public or private telecommunications networks, power or fuel or the default of suppliers or sub-contractors. Our performance under our contract with you is deemed to be suspended for the period that the Event Outside Our Control continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Event Outside Our Control to a close or to find a solution by which our obligations under such contract may be performed despite the Event Outside Our Control.

 

Protection of Personal Data

You agree that any personally identifiable information you provide to us in connection with the Store may be dealt with by us in accordance with the terms specified in our Privacy Policy available via the link at the bottom of our site.

 

Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using the Store, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

 

Waiver

If we fail, at any time during the term of our contract with you, to insist upon strict performance of any of your obligations under such contract or any of these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under such contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations. A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver by us of any of these Terms will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

 

Severability

If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

 

Law and jurisdiction

Contracts for the purchase of Products through the Store and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales
